What is DUI?
Driving under the influence is the illegal act of operating a motor vehicle
while impaired by drugs and/or alcohol, or the illegal act of operating a motor
vehicle with a blood alcohol concentration of 0.08% or higher.

What is a breath alcohol test?
A breath alcohol test is a test that is administered by law enforcement
to obtain a person’s blood alcohol concentration (BAC). A person’s BAC
result reveals the amount of alcohol he/she has in his/her blood stream. If
a person’s BAC is 0.08% or higher, he/she is considered intoxicated according
to California law, and he/she can be arrested for driving under the influence.

What is a field sobriety test?
A field sobriety test is a coordination/agility test that allows law enforcement
to gauge if a person is impaired by drugs and/or alcohol. It is believed that
if a person is impaired by drugs and/or alcohol, his/her coordination will be impacted,
which will result in poor performance of the field sobriety tests.

What are Miranda Rights?
When a person is arrested for a criminal offense, he/she will be read his/her
Miranda Rights. Miranda Rights inform a person of his/her right to remain
silent, right to an attorney, and right to have an attorney appointed to him/her.

What is a Notice of Suspension?
After a person has been arrested for driving under the influence, he/she
will be served with a Notice of Suspension by California law enforcement.
The Notice informs the person of his/her right to request an Administrative Hearing
with the California Department of Motor Vehicles (DMV) to avoid the suspension of
his/her driver’s license. From the time of his/her arrest, the person
only has 10 days to schedule his/her Administrative Hearing with the DMV.
If the person does not schedule his/her DMV hearing, his/her driving privileges
will be suspended for a set period of time as ordained by the California DMV.

What are the penalties for DUI?
If you are convicted of DUI, you may have to spend time in jail, pay monetary
fines, attend DUI School, have your vehicle impounded, have your driver’s
license suspended, be placed on probation, and/or have to do community service.
